Issue with new car purchased from seat dealership

Hi all,

I hope I can get your opinions and advice.

I recently in the last month traded in my mk2 cupra for 2014 cupra 280 from a dealership up north , what name just yet. We had a few issue which when I purchase the car they failed to register the car in my name? Which we finally resolved, well sort I received the log book but they have imputed my name incorrectly. Which I am now in the process of sorting.

Anyway, I have been enjoying my new purchase and while looking at instagram found the dealership instagram account. So I followed them and while doing so found my new car still in the post section. To my horror, I found thta the car had been had a stage 1 remap , which they included in their list of hash tags. I originally found the car on auto trader website and then checked their own website out. There was nothing at all in the advert to advise that this had a performance software on the car.

As you can imagine, when purchasing something from a authorised seat dealership you expect that they would not being selling a modified car and more to the point be transparent in their advert regarding this.
On top of that, I have insured the car as being standard , which was the case to my acknowledgement, based on their own advert and purely not aware of this performance software, which they did not state or upfront about.

Then next concern is that I purchased extended warranty on the car to give me 3 years peace of mind and concerned now that anything which goes wrong will just be refused because of this stage 1 remap, which I did not perform myself.

It is also not clear weather the car has been reverted back to standard form while in their possession before selling onto to me?

I have emailed the dealership with the screen shots of the instagram post but a cornering email to clarify this but had no response.
If I was aware from the start that the car had been remapped , I would not have purchased it, as I don't not know what software has been uploaded on to the estate ecu and how the car was treated by the previous owner. He only had it a year , so chances are not well.


What should be my next step ? Any help much welcomed.

I have just had a phone call from the dealership and they have advised they cannot confirm it has or hasn't been remapped. They have requested I got to a specialist or local seat dealership to investigate and if it has to be removed. My question to them was , I am covered by warranty if any breaks IE engine or gear box. They have said no!!!!

They have not been that helpful and considering they sold me a car with a remap on the won't cover but Surely if they would have a legal obligation due to false advertisement?

I will talk to trading standards and I will disclose the dealership as I don't want anyone to experience this. It has left me with potentially financial nightmare if anything happens

Hmmm, thats cr@p they won't honour the warranty when it's their fault. As for the insurance... I've read the small print of my policy in fine detail. Basically says that I can't be held accountable for a mod that I didn't honestly know about and isn't obvious on a car I bought in good faith. I'd say you fall under that category.

But... I had my previous car flashed back to stock for £60. But my insurance only charged me £80 extra for the year for a remap. So depends which way you want to go.

Can you share the name of the dealer please?

We live 'up north' and we're currently looking for a Cupra. We would like to completely avoid this dealer if possible.

If you don't want to share the name in the open forum, please pm it to me. It will be purely for my information, and I will not post it.
