Christmas drink with learner

Recently there was a thread on here asking about what the law says regarding learner drivers and using them to drive you home from the pub.

Ok, I decided to do some research so here is the answer according to the law.

Firstly, the accompanying qualified driver must be over 21 and must have held a full uk licence for more than 3 years.

The driver (not the learner) must be in a fit state to drive and must be below the legal alcohol limit whilst accompanying the learner.

So a word of caution to anyone considering doing this, you could if caught, be prosecuted under a drink driving offence.

You can always phone those chaps with the fold up motor bikes. They come to the pub on it, put it in your boot, drive you home, then get it out and burn off into the night. Very cool service.

Over prescribed limit

If learner was driving and qualified driver in passenger seat.....but over the limit.....

Simple rules used by Plod are Use, Cause or Permit.

Learner would be driving unsupervised and full license holder would be prosecuted for a number of offences.
It's a minefield and punishments would be harsh.

How about this....
If the drunk full licence holder owned the car he would have to take the rap for the learner using the car without insurance and he would get grassed for permitting drive no insurance.
Or if too pi$$ed learner might get a technical TWOC
There are dozens of variations to pick from and would depend how bad PLOD wanted to nack you up.
