Hi guys,

I purchased my Leon FR in October from RA Huddersfield part exchanging my 307 with them supposedly clearing the balance with the finance company.

Checked my bank account today and noticed I was further in the red than usual at this time of the month and still paying for the Peugeot.

Turns out the cheque RA sent to the bank bounced leaving me paying for 2 cars.

Now they've gone bust Sytner only purchased their assets so I'm out of pocket by a couple of grand.

Any one had similar experiences with them? Any luck getting any money back from the receivers?

I assume you have the details of the recievers?

Hi Sorry to hear about your problems.

As a bit of advice I would contact your hire purchase / finance company and tell them of the situation. They still hold legal title to the vehicle even if it has been sold on by RA or still in their stock.

This means that the vehicle can be reclaimed by them / you and you get the ownership back! This even applies if RA have retailed this onto a private man or sold it to the trade!

At least then you have the vehicle back and you can sell the vehicle and pay off the finance.

This is a much better situation than what you are in at the moment ie no car and having to keep up with the payments.

Strictly speaking the finance company can insist that you pay off the balance immediatly if you no longer have ownership of the vehicle!!!!!!!!!!!!!!

Spoke to HP Company this morning Bank of Scotland who werent helpful and basically said theres nothing they are prepared to do. I either have to pay the amount up front of continue paying my direct debits so not to affect my credit rating.

Receivers said too titty and be thankful I dont owe HP company 10k like some people affected.

Screwed all round. They mentioned something with my new HP agreement but the gits dont make any reference to my previous motor on the agreement, for the the part ex.
It just shows Cash advance rather than implying a Part Ex.

Nigel - Thanks for your advice I'll probably give you a call. I'll definetly travel a bit further for Servicing and avoid Sytner. Barnsleys only 40 mins away.

Just wondering what the outcome of this was?

If you still have no luck I would contact consumer advice.

I don't know the ins and outs of the law, but if RA have sold the car on I think they have done it without a legal right to do so.

Any HPI check done on the car will come up as money still owed on it.

By the way I noticed that the managing director of RA SEAT is still the same person even after they have been bought out. Might be worth giving him a call to find out what happened to the 307, could be a long shot as I'm sure he would deny all responsibility though.
