So I've had my 2012 Bocanegra for 3 months now. It's spent 3 weeks of that in the garage getting repaired, the usual oil issues. It went in last tuesday 20th for the 4 hour job of engine breathers and I still don't have it back. They keep finding they need parts and delaying its return. I'm paying finance and paid to be put up in a pokey standard ibiza, which makes me unhappy as its nowhere near 'like for like' My warranty is till next August, but I'm starting to loose my tether with it quite frankly. Does anyone know where I stand on getting a refund and they can have the thing back? I'd rather put my money into something I can enjoy for more than a month without it going to get fixed.

Any help would be golden.
 
You've got little/no chance of a refund mate.

I went down this route with a solicitor friend years ago when I bought a new Ibiza, I wanted to reject it after I had to take it back to the garage literally dozens of times, wrote an official letter and everything, you'll get nowhere trust me.
 
Been looking on Citezens Advice and they make it look so promising but maybe not, would this not stand as such?

"Getting a refund

You may be able to ask for a full refund if:

the fault is serious
it is within a reasonable time of the sale and
you have stopped using the car.
Sometimes a partial refund is more appropriate, for example if you have used the car for some time before you noticed the problem.

If you want a refund then you will have to prove the car is not of satisfactory quality. If you are asking for a repair or replacement, or a refund because the trader cannot offer a repair or replacement within the first six months, then the responsibility is on the trader to prove the car is of satisfactory quality.
 
Hope you get this sorted soon mate its crap. And push for new wiper blades!!
 
This is the issue, "reasonable time" there is no clear definition on what that actually is, is it a week, is it 6 months, there is no definitive answer so can easily be skirted around.

Also in terms of replacement, you'd at best get a second hand car with the same sort of mileage and spec as your current one to replace if you did get a result IMO, and lets be honest, when you've paid for a new car would you really want a second hand car as a replacement.....

Citizens advice was my first stop then I consulted a solicitor where I worked, got him to draft me up a proper letter and sent it to them, got me nowhere.

Asking for a refund and getting are two very different things mate, dealers in a lot of cases will fight tooth and nail on doing basic warranty repair so you can imagine how much they'll dig their heels in when it comes to swapping out a motor.

If I remember rightly your fight is also with your finance company as they are the ones who own the car until you've paid it off.
 
Ahh might have to just suck it up. Hope the lucky warranty company get me when my manufacturers runs out. But their cover only goes up to £1000 and a new engine is £5500. I'm just so worried about running out of warranty and boom. Also i'm paying £70 a week and going home in a crappy courtesy car. Just had a word with my step dad who knows and he says he doesn't know where i'd stand either :/
 
It's awful mate it really is, you spend a lot of hard earned and just end up feeling robbed and start to dislike the car, I did anyway.

If it were me knowing what I know now I'd try and push hard for some form of compensation for the time your car has been off the road, maybe free servicing or something like that.

By all means try and reject the car if that's what you really want to do but I'd imagine it will eat up a lot of your time and you'll feel stressed to hell and possibly still not get the result you really want.
 
Yeah when I pick it up tomorrow (maybe) i will make sure i see the service manager, as the lady on the service desk doesnt give 2 monkeys. I'll ask him for something, maybe he will agree to do wipers. Ill see what happens and start exploring the possibilities. Might end up with a daily drive and spare the Boc for days off but its not ideal
 
Looks like I'm not the only boc owner with problems!
I bought mine back in May, within 2 weeks the car was littered with stone chips, along the front end and under back of the car behind the back wheels.
I've been fighting my corner for 6 months now, seat johnsons in liverpool failed to get back to me after ringing them 8 times!!
I then went to my local dealer, they were helpful at first I took it to their approved body shop who compiled a report and sent it to seat. He told me on the day the paint was of poor quality and it hadn't been lacquered to a good standard. 5 weeks on I have heard nothing. I rang my local dealer 5 times who have also failed to get back to me!! I now have a case opened with seat UK and I will not let this lie.
For some unknown reason they feel they right have a right to mug us off as customers after taking out money.

My car is also using excessive oil. I took it in and they said I would have to foot the bill for the tests if it came back okay. This is totally unacceptable when it is a common problem with the car. I would take it further if I was you. Do not let it lie and get what you want.
 
Don't worry I will. I'm even more fired up now as they have charged me £250 for damage on my courtesy car that has magically appeared. Got my Boc back eventually today, told them see you again in 2 weeks when I left
 
That was the excess, the body shop quoted a lot more if i prefered to pay that. Good news is I've secured the new wipers for free
 
I'm beyond it mate, I really am. The proof is in the pudding, when it's been in for a week instead of 4 hours you would imagine it to be more than 'fixed'. Maybe it's been so overly 'fixed' that its broken again, I just don't believe it.
