the only real way out.. and to cause i a huge delay ( could be needed so that you tick over into you next insurance year where you can protect no claims ) is to say that when she stepped out of the car she was on her mobile.. and state that you believe she was on the phone.. they will have to do checks.. and if it works out she was its not you fault & you can claim on her, this also applies for if at any time in her journey she is found to be on the mobile.. its her fault!

I like this idea lol. If i do go down the route of settling outside insurance I will definitely make sure i get documents signed saying this is a full settlement and can't be revisited etc.

contact her asap, try and get it done out side the insurance, so just pay to get hers fixed

other wise it will go against you, im sure your not meant to be doing 70 on a dual carrige way, and esp not overtaking on a inside lane if u was

you hit her from behind

if u take it any futher you risk losing any no claims etc etc

I think you want to recheck dual carrigeway speed limits for cars ;)
You can indeed also undertake legally at 70 and under if she suddenly slowed down in the outside lane.

Correct, for example if she was making a turn. Which she was doing, until she changed her mind and kindly implanted herself in the front of my car lol

to be honest the insurance company will just play the stopping distance card, you should leave enough distance to be to stop from whatever speed you where doing, between you and the car infront.

even if she's in a different lane, and turning right? what about on the motorway? do you have to account for all three lanes when calculating your stopping distance?

difficult one to call but basically, you're screwed. unless she 'fesses up, or you have a witness.

This is the reason why there are so many tossers driving around on the roads (jay, im not aiming this at you as you may be a great driver, its just a good example), the driving test is just too damn easy!!!!

How can it be that a guy can get a perfect score on the test and not know something as simple as the national speed limit on a dual carriageway????

It beggars belief!:wtf:

Also, to add my 2p, shes at fault but you can't prove it so the law will side with her as you were behind. I don't see that you have any choice but to look for your lube on this one.

Yeh its hard to leave a stopping distance when shes in a lane next to you lol.

Although there is now fantastic news! A lad that works in a nearby shop, stopped me in the car park today and asked if i got the car sorted after the crash. He was walking by and saw the whole thing! If thats not lucky i dont know what is, i've just got to sort out how i organise a whitness or whatever if it does go through the insurance now.

Then sue her for mental anguish and trauma, lying about accident details, and the dry cleaning bill for making you sh1t yourself.

Then, have her knee capped for good measure.

Oh, the bit about not knowing speed limits also raised a chuckle!

make sure he says he saw the woman's car indicating to turn right with brake lights on... thats a good indication of her intention to turn right!

Good luck mate, I have been going through all this crap for the last 18 months. A guy chopped me off on a roundabout while i was on my R1, put me in hospital for 2 weeks and been in and out of Hospital since the accident, was off work for 9 months. And guess what...........No whitness's!!!!! my word against his :cry: it sucks

yeh its so frustrating. Ironically i only got the car repaired a month or so ago from where a van crashed into the back of me while i was waiting at a round about. I think he was on the phone, he reversed off and didn't even stop... Finally got that all sorted where his insurance paid out because he wouldn't respond to them. Now this happens....
