Would removing the rear silencer and replacing it with a straight through section result in an MOT failure.

Just remove the middle, it's a reasonable level of noise with a few 'nice' spots through the range and doesn't cost a fortune. Probably helps with turbo spool but I don't have numbers to back that up. If it's a normal cupra; as recommended by Lee on here, get a replacement non-res pipe from a 1.9tdi. Provided you have a grinder or a sawsall and an ounce of common sense you can replace it yourself in a couple of hours using axle stands.
 
In that case, you could probably get away with removing the rear box. I take no responsibility if you choose to do so but I know it's a common 'mod' for the vrs. Search "mufflerectomy" for more details
 
I think he means remove the rear silencer and replace with a straight through pipe.

I have a Powerflow branch close to me so I'll drop in and see how much it would be to remove the rear box, replace with a straight through peice of stainless and aadd a nice 3" twin tip.:)
