As I knackered my transponder in my spare key, if I get another key from ebay and remove the transponder can it be programmed to my car via vagcom? Or is it a dealer only jobby
 
Depends very much in your your and immobilizer generation. For example IMMO-3 transponders are being locked once they were matched to a car, after that you can re-learn them to this car as often as you want but there is no way you will ever match them to a different car.

Mind giving us some more details like the mode and model year (7th, 8th and 10th digit of your car's VIN)?

If I can reprogram a new transponder that would be spotty dog! Im not 100% sure the transponder I have is new although the key is uncut its from ebay so may well have had another life, does this matter
 
From my experience, the transponders don't tend to be re-programable, so if they have been previously coded to a different car, they will not work.
This is what happend to me, as of the two flip keys I bought of ebay, neither of them would program to my car.
You can check to make sure a key has the correct electronics in it so that it can be matched to the Immobilizer by:

[Go!]
The value in field 3 must be 1. If value is not 1, the key is not capable of being adapted to Immobilizer.
You can check each key in this manner.
