Take advice again, tell your solicitor:
There was an agreement (oral contract?) to replace the car.
The repair they are suggesting has already been attempted and it failed.
The dealer needs to be given a deadline to resolve the complaint.
Get advice on the timescales that govern what actions you can take.

There is a difference between you "rejecting" the car and the dealer or SEAT "replacing" the car. And different criteria and timescales apply.

On Monday you will have owned the car for 9 days and the timescale will be critical for some actions. Get professional advice from a solicitor or trading standards on what options are available to you. Don't take advice from the dealer on what you can and can't do.

If your only option is to let them repair the gearbox you need to find that out for certain now!

with it only being the mechatronic unit that is nackered i cant get a new car because apparently this has happened to over 25000+ vw/seat/skoda/audi vehicles in the past 3 years! so its a common fault for the vag dsg cars :/ so they have said its an easy fix and they are willing to get it sorted on monday so i can have my car by tuesday? the way the manager has explained to me the mechatronics unit they tried in my car to fix was from a different car they had in the garage, and these mechatronic units are built for your car using the chassis number ?? so that one they put in wasnt correct anyway, i have spoke to seat customer support and they have told me the exact same thing that i have got to let seat uk fix my car because its only a small problem and easy fix, and im not liable to get a new car, id only be able get a new car if it was something major like the entire gear box and was going take 3/5 weekws replace, so thats the story :/ looks like ive just got put up with it now and hope tht my car is returned by tuesday and running fine like when i picked it up. i have also been looking on the golf mk5 r32 and audi TT forums and its very common on there and easy to fix.

If you take the car back (which I guess is what will happen), I would make them agree to providing a new car (immediately) if the slightest problem occurs with the gearbox, or any of it's related components. Get it in writing before you take the keys, and give the car a bloody good run.

thats what im going to do mate as soon as i get the car back this week, im going try run it most days just to see if the fault returns, which im hoping it wont :) even though i dont like giving my car full power alot , i may have to a few times just to see if it is ok

Like the man says and they are dragging it out now as your sale or lack of if you reject means down on monthly figures and lets face it the car market is flatter than Kate Moss's tits at the moment and every sale counts.

However............... If it can be repaired then so be it. Mine has never been the same since it went in, but maybe Im just unlucky!

i told them about your car mate and they have told me mine will be the same as the day i drove it away from the show room

Like the man said, salesmen = bullshitters (to be fair a percentage of the time) tell you what they want you to hear, if it were a TV, conservatory or what ever the shiny suited purveyor of goods is trying to punt out to you. Bless em they will waffle till the cows come home

if you bought your car new and your gearbox has failed mechatronic or not you are entitled to reject the car.
You are being fobbed off from the dealers , just think if that failed after 2 days what else can go wrong , there is no guarantee that your car will be fine , you have nothing to comapre it to except your short journey you have made.

i made the mistake of letting seat fix my car and i regret it every day , stick by your guns , if you want to reject then tell them , put it in writing and request it.

If your solicitor confirms that you can reject the car then you should reject it. The dealer or SEAT will prefer to offer you a new car rather than hand you back your money. You would then have a choice of money back or a replacement new car.

Get the legal position from your solicitor. DO NOT take advice from the dealer on what you can and can't do.

have you spoken to anyone that can confirm your legal postion? if not bearing in mind how money you are spending on the car, don't you think this would be a REALLY good idea? As Rji says find out where you stand and tell SEAT what you want from a postion of knowledge!

If it needed a full gearbox replacement or even a full engine replacement they would tell you the car would NOT be replaced. The gearbox or the engine would be replaced. They told you they would replace your car with a new one but now they are telling you they will not. What can you believe?

Try to keep the dealer on your side. Legally your complaint is against the dealer but if you have a strong legal position the dealer should push SEAT to resolve the situation.

SEAT wont entertain a direct rejection , it has to come from the dealer , ie you inform the dealer of your right to reject and then they inform SEAT , they will try to persuede you other wise , i wish i rejected mine and didnt go down the route of having it fixed.

We have had six months of fighting, arguing, delays, misinformation, broken promises, changed plans, fobbing off and we are still trying to get something done.

If I was in the position of Jimmy.D90 and there was the possibility of rejecting the car I would take the money and run. It has been nothing short of a six month nightmare trying to deal with this company. 25,000 DSG failures in 3 years - that's nearly 700 failures a month. It must have cost millions to put right. And they still haven't solved the problem to prevent it from happening on new cars.

right what i have done i have rang seat uk again today and spoken to the manager there, and he has informed me that they have ordered a new mechatronics unit, they are hoping its here by tomorrow, and they can get me in my car by thursday, i have said to them i dont want anymore messing around i just want everything sorted, i have also spoken to him about other ppls dsg problems and he said they happen quite common, but he says there fixed easily ? so i asked the question arnt they going ever correct there faults, and he said yes when they get enough complaints lol so thats that doesnt look like theres much hope of me getting a new car like they said in the beginning :/ i just hope when i get my boc back its running smooth and never fails on me again

Just walk away and start again. On Saturday you were saying they would fit a new unit on Monday and you would have it on Tuesday, now it's being fitted on Thursday. You are being spun a line.

The second mechatronics unit won't be different to the first but it will have wasted more time.

You say there is a 14 day cooling off period. It ends on Saturday.

If you let this go on you will be writing about it for months and by the time it is fixed you will regret it getting it fixed, hate the car and want shot of it.
