Advice needed on warranty and finance please

Hello all, i bought a leon cupra mk2 about 7 months ago under finance and it has been back at the dealership 6 times with serious engine and gearbox issues,

a short list would be, jumping out of 2nd gear, engine light is on, turbo issues (overboosting and boost surges) stalling while driving, black smoke while on boost, backfiring and a warning light on the led dashboard screen for low oil pressure...the list goes on but basically i was hoping someone could give me advice on what to do and how to approach the situation properly and legally! It has become so much of a problem i try to avoid driving it !

The car has been back to the dealership were i purchased it many times but the problems aren't being fixed to a good enough standard considering the price im paying for the car and the age of it.

I am just wondering if the dealership have to replace the car with another of equal value or take the car from me and clear the remaining finance? Because due to circumstances at the minute i cant afford for the warranty to run out and be paying to have all these issues fixed from my own pocket. im not worried if they dont replace it with a cupra but i just need a car that isnt going to break every other week.

I personally think due to me being young that the dealership isnt taking me seriously but i need some advice anyway,

Also forgot to say it has been back at the dealership because it was leaking coolant very quickly aswel, needed a new radiator and pipes, but the interesting thing is a friend owns a body repair shop and he evaluated the car and said the front bumper isnt aligned properly and seen overspray inside the car on the steering wheel, he doesnt think its a cat c or d car because a dealership wouldnt take that risk but something isnt right anyway

Sounds like you have had no luck.
Is the dealership a seat dealer?

If so try contacting seat uk to complain

Im sure you can give the car back as its not fit for purpose, my advice is ring the finance company and say whats going on and your unhappy with the car and its not worth the hassle an money.

ive rang citizens advice and found them very helpful ! They asked me if i had passed the 6 month threshold on the finance and obviously i have but they gave me some numbers for local solicitors but i found the solicitor i seen very unhelpful, he basically said tuff luck. the finance company didnt sell me a dodgey car they just lent me money to buy a car. the only thing i can do is ask for a car of equal value or sell the car but to be honest i wouldnt sell it to someone it wouldnt be fair !

Yes it is a Seat dealership, they know of the problems but there has been no improvement in fixing them, ideally i would love to keep the car but its not being fixed and i dont want to be stuck to foot the bill for a new engine

I wish i hadnt signed an agreement to be honest but im just trying to make the most of a bad situation at the minute,

How old is the cupra? How many miles on it?

its 2007 and i bought it with just shy of 41,000 there is 43,850 on it now. it came with a dealership warranty, not a manufacture warranty

Too be honest the car i bough was modified to start with, but to be fair it was with quality parts, there was a milltek exhaust, neuspeed air intake and h@r springs but i assumed i was getting a good car considering the age and miles plus a FSH,

But basically to date there has been warning lights for coolant levels, oil pressure and the engine light, always taken back to the dealership for repaired as it happened.

most recently it has started backfiring, stalling while driving and getting boost surges ( boost surges/overboosting according to Seat) and it has been back to get the gearbox fixed for the 6th time on wednesday coming, linkages, 2nd and 3rd synco's have been replaced also the gearbox mount and one of the engine mounts were replaced last week after a friend noticed alot of engine movement. (after Seat had replaced the sycro's...)

if i was going to be really picky about it the cd player is also faulty as it pops just cd drive defect when i try to play a cd

With all due respect, I think they would probably tell you where to go due to the fact that the car has been modified. I know they are good parts but Seat have no way of regulating them. It could be argued that dodgy fitting of an exhaust, poor parts etc could cause problems with the engine.

I will fully agree with you but i bought the car from Seat with those parts already installed, i havent modified the car myself from the day i bought it, they put the warranty on the car with the part already on itand the re-map included

Technically the finance company own the car untill you have fully paid for it, so there for if you are havin issues with it i would ask them your not happy and its not fit for purpose.
