brake lights wont go off

so i get to my car and its flat , i then noticed the rear drivers side ad spoiler brake lights are on. i removed the full light switch cluster to make sure its not this shorting or somthing, still on!.

i had to remove the battery and stick it on charge, when reconnecting the battery the lights are now of but for how long i dont know, ay possable ideas?

brake light switch a possable item to look at?

Aye brake light switch went in my mk4 ibiza. Easy and cheap to replace so I'd get one of those first.

seems it is, had to remove battery + in work last night. it i hit the peddle itll go of for a few minutes
