That sucks, bad luck. Your car looks familiar - were you at some sound-off thing near Ipsden/Wallingford a couple of weeks back?

It might well be the case that each driver has to claim off the driver behind in a pile up. Or they might just go to the last car in the queue... be interested to hear what happens.

I think you should be alright insurance wise.
I know someone who was involved in a horrible accident joining the m4 when an artic ploughed into the back of a queue of cars.
The lorry driver and was found responsible and his insurance paid out to everyone else.

I'm sorry to hear about your leon though but at least you weren't hurt and from what it sounds like it wasn't your fault.

Should be interesting because your rear lights are tinted if the Audi driver says he couldn't see your brake lights.. what the insurance company does.

Assuming the mods are declared, you may get away with it, but if they want to be gits (as is usual) you may end up with issues..

I'm guessing here but I suspect this is probably not the sort of thing the poor bloke wants to hear right now...how about less of the scaremongering?!

I think, if your lucky, you may find that your insurance company will claim for the broken BMW off the Audi's insurance... Thats what they did for me when I crashed my Fiesta into that back of a Merc on the m-way, then a corsa hammered into the back of me... they claimed it all through the Corsa they claimed he caused the whole thing... when infact it was my shoddy breaks that caused me to hit the Merc and the Corsa being driven by a Chav about 3 ft from my rear bumper... lol

Had to be cut out of my car... was scary :-(

As he said he was stationary, more than likely on handbrake so the lights would not have even been showing.

funny for this reason i always keep my foot on the brake with the handbrake on as well until a car has stopped behind me.

Gives you a better chance of not being hit.

my arguement is that i have an mot as of 2 weeks ago roughly that states my car is to standard. the lights were tinted 2 years ago.

If the lights were found to not produce sufficient light then i would not have an MOT, simple.

they can test them if they like too cause i know tonnes of light goes though em as they arnt heavily tinted.

there is also the 3rd brake light which hasnt been touched.

there is no way that man did not have lots of red lgiht shinning at him.

To put it exact, i was coming off a rounderbout down the road i always look several cars ahead, I saw that someone was joinging from the parking lot next to the road, They had pushed into the traffic and the queue stopped suddenly, I came to a quick but not violent halt behind the bmw. I had the time to look up in my rear view, as you do, and I could see the Audi coming straight towards me and braced for impact. Probably about 5 seconds after I had stopped.

I did not have the hadbrake on and I removed my foot from the pedal when I saw him coming as i had been told by the IAM this was the best course to prevent broken ankles.

Its probably not a good idea to share that on a public forum, insurance assessors will also use this site (looking for undeclared mods etc) and although they probably won't be able to do anything about this retrospectively everyone knows they're moneygrabbing b*stards and I personally wouldn't give them any opportunity to screw me over (which they would do without batting an eyelid).

Have you got any witnesses to back up your story James?

the guy in the bmw said he heard him hit me before i hit him, thats about it. one guy stopped but he was a medical something and then left when everyone was ok.

I dont think you have anything to worry about really insurance wise. You were rear ended while stationary, theres not really any way they could put you at fault..
Never agree on the first sum of money they offer you if it is a write off though. Thats them just testing the water to see if they can get away with paying out what they know the be less than the value of the car..
