So after much thinking and test driving a few cars, I settled on a Leon yesterday and stuck a deposit down, a March 2015 1.4TSI 150PS FR with 14500 miles to be precise.

I looked over the paperwork last night after coming home and noticed they had sold me an extra 12 months warranty. Now this was under the premise that I was going for finance before I decided I would be going for cash which was explicitly stated before we shook on the deal. So I called them up today and the salesman said that if I cancel the optional 12 month warranty which was £329, I would be left with only the remaining manufacturers warranty ie 1 month, until March 2018 and there would be no warranty after that.

The reason I looked at that car was because it stated on Autotrader it was a Seat Manufacturer Approved vehicle and would come with 12 months warranty, 12 months roadside assistance and a 102 point check.

When I mentioned to the salesman today he said it wouldn't have the Seat approved used warranty etc. and said the vehicle was not directly sourced from Seat meaning it is not a Seat approved used vehicle even though it says so on Autotrader.

What should I do? I'm thinking of calling Seat UK customer services tomorrow as it's closed now, and stating that this dealership has misled me and not adhering to what the vehicle was advertised on Autotrader as being a manufacturers approved used car. I took a screenshot of the advert on Autotrader before it was taken down if that helps, should I also complain to trading standards or any other services out there (suggestions welcome) about the fact that they have basically misled me into buying the car or would it be my own fault for not asking for clarification before handing down the deposit. I'm due to collect the car on Monday 5th February.
 
I remember someone having a very similar issue recently about a used Leon that was sold as 'Seat approved' but actually wasn't. I'll try and find details.

Scrap that it was too long ago for me to look it up. Im sure the resolution was 12 month goodwill warranty by the dealer.

If you're not happy with the deal simply tell them, ask for your deposit back as they misled you and look for another. I'm sure they will try and offer u something to save the deal.

Surely misrepresentation under the Trade descriptions act?

I would've thought so too, something along the lines of the Consumer Rights Act 2015, whereby it is mis-advertised.

I called them back there now and said I don't want the 12 month dealer warranty they stuck in for £329 and spoke to 2 different salesmen, 1 who sold me the car and another who answered the phone when the salesman who sold me the car was busy. Both had differing stories, 1 saying the car was mis-advertised in saying it was manufacturer's approved used and that the marketing team would have to take a look at it and the other who said they don't control Autotrader that Autotrader put it upon themselves to list it as approved used, saying that only their 2017 Leon's are approved used.

A call to Seat UK customer services are definitely in order I'd say tomorrow and see what they can do.

What dealer was this? Begin with Ag.....?

I'm tempted but really want the car as there simply is no other similar one in the whole of Northern Ireland even though it was slightly overpriced.

chrisRibiza it begins with a capital S and is in Lisburn, I probably would've rather bought off the Agnew Group as they seem better value. It's a real shame really as my dad bought a Peugeot 308 last year from the same dealership beginning with an S but the Boucher Rd branch and the service there was top class, in fact the salesman who sold my dad the car in Belfast is now a sales manager at the Lisburn branch and kept coming over to make sure everything was alright. Been asking for him today and all I got was "he's busy" and then when I called back not long ago they said he was away home, complete opposite level of service between both branches! Funny enough the car seems to be the same as yours, Apollo Blue with convenience pack and I live in Ards too!

Ah I'm surprised actually TBH. I use the same dealer as you and have had no issues with them at all. Infact, I would never buy a car from Agnews again.

Hopefully you get sorted!

Oh I see, were Agnews poor customer service? I'm thinking of avoiding SERE after for servicing and thinking of buying a Seat Extended warranty online and any issues I have bring it to Agnews, however, Dave who used to be on here from SERE gave great service, delivered parts to my house on his way home to Bangor, shame the sales team don't seem to be as good.

100% do this. Warranties and the likes are giveaway sweeteners that are used to settle complaints or secure sales when required. There is absolutely no way that they will let you just walk away from the sale, especially when they know they are in the wrong. Do you really think the salesman is going to want to tell his manager that he's had to return a deposit because a sale was cancelled? He will get his balls to play with.

Stand your ground. Phone again and ask to speak to the sales manager or branch manager, not the sales man. Say you want to cancel the sale if there is no 12 month warranty included FOC, as advertised. If they are 'unavailable' leave a message saying that you have paid a deposit but now want to cancel the sale because the vehicle was mis-advertised. You will get phoned back very quickly and you will get the warranty.

Would they give the deposit back though? I signed paperwork agreeing it all etc and it says on them deposits are not refundable, and I think they'll think I'm bluffing as I travelled at the peak of rush hour taking more than an hour just to see the car again and stick the deposit down last night. I'll have a word with Seat UK customer services tomorrow and then follow up with a call to the dealership and speak to a manager and see what comes of it.

Maybe look to see if they are an accredited dealer with the Motor Ombudsman.

Even though dealer has said Auto Trader puts the adverts up, they should be checking the info is correct.

That's good to know but what would the return be under? Not as described seems most likely to apply in this situation. They are indeed an accredited dealer with the Motor Ombudsman, when I look them up on the ombudsman website they appear.
 
Eh I am not. Never thought of that, how do I do so on an iPhone? That sounds like a very smart idea.

Recorder app, can be set to auto. I don't know about UK law but recording conversations here is only illegal if both parties are unaware of it. In other words, you can record your own.
