am i within my rights to return brand new wheels?

i recently purchased some wheels from a certain online shop . however they didnt produce the right fitment anymore. so i asked if he could supply some adapters as i really like the wheels . he then told me the offset was wrong also , and told me they would be very wide. however he couldnt specify how wide they would actually be . so i agreed to go ahead . the wheels came without the adapters as they are being custom made. when i looked at the fitting , they are extremely wide , so much so i would guess that the wheels would be at least a few inches wider :(

the website states that i can return purchases within seven days, so i called back to say i would be returning the wheels . however the guy said he had signed a disclaimer as he always does with special purchases , and i was unable to return the wheels. he then gave me the number of the place he sourced them from and said i should call them on monday, however they will be unlikely to help me.

although he did tell me they would be very wide, he never specified just how wide . and he never mentioned anything about a disclaimer when i ordered the wheels.

also , having the wheels so far apart , does this put extra pressure on the wishbones and hubs ?

is this correct? and ive been extremely naive ? or is there something wrong here?

i havent stated which website/company as im not sure if im allowed .

if its custom made then usually you cant send it back but you should be able to with the wheels you do have rights to send them back most places are 14 days or so without quibble if in doubt speak to citizens advie

yes im aware of the custom made part . what do you suggest i do now? send him another email reminding him of my rights to a 7 day cooling off period in which i can return the purchase? and also remind him he never notified me of this disclaimer?

1) you were told that they won't fit your car, but you accepted them anyway
2) it doesn't matter if he signed an NCNR, you didn't (but see 1))
3) yes, you've been naive, why would you commit to buying something that doesn't fit.

this was there response when reminded of consumers rights.

It's says in our returns policy 'faulty or damaged goods', the wheels are neither faulty or damaged. I told you it would be tight to fit the wheels and two times said that I wouldn't suggest getting the wheels for those reasons but you still ordered them. The wheels are also a special order as we don't normally purchase anything but VAG fitment. I have signed a disclaimer with Performance Wheels to says the wheels couldn't be returned and for that reason I can't accept the wheels back and you will need to contact Performance Wheels about this matter yourself. I will also contact them and also try to get them to take them back. By all means look further into it but it is in our 'Returns Policy' on the site.

.....yes i was naive, got starstruck by a set of wheels, which in total with tyres cost 1600 of my hard earned. and he did suggest i get some other wheels , and that they would be wide, however , he never specified just how wide . it sounds to me like he wont accept them back, purely because the company he got them off (performance wheels) , refuses to take them back . but like u said he signed a disclaimer to them , not me to him . and as for the policy on them being damaged? am i still not entitled to return them through the 7 day cooling off period? i will name and shame as soon as i know im not falsly accusing someone . as they get a lot of trade of certain forums ie vagcars.co.uk

when complaining ALWAYS take the persons name and time of call , ALWAYS check with trading standards/consumer advice to see where u stand , AND if your not happy sometimes u can ask if they have an aubertor u can refer the case to ( they usealy fold when asked this cos it costs em a fortune when its refured to them ) But only large companys are inderpenditly aurberted ,like FENSA for window companys ect ...... good look and i feel your pain.

haha i've learned a few things after my temper getting the best of me with returns etc just be polite as you can ppl will help you more if you are rather than be blunt and say do it or i go legal

just a bit of advice

yeah i paid on my credit card, why does that change things?

what vehicles are the wheels actually made for ? they have a pcd of 5x114.3, offset is 33? what exactly is the offset too?

and just how wide exactly are pcd adapters?

As Chris said, when you buy goods on a CC, the CC company is also legally involved in that purchase, and as such, when a complaint arises, they get involved. Its very handy as which company wants to get involved in a legal dispute with a CC company with a very large, dedicated, legal department?

As already stated your rights under distance selling regulations are different from normal sales of goods act rights.

If he is being difficult and despite being nice to him and trying to appeal to his sense of goodwill he is not going to budge tell him you will be reporting him to the trading standards authority and see how he responds. If it's in the negative, report him to said authority and get a solicitor to send him a very nasty letter.

If he tries to argue that you entered in to a contract with him, (which legally speaking you have by offering to accept his offer to treat, which he subsequently agreed to), then just remind him that contracts are only binding in so far as they are governed by the laws and bylaws of the UK.
