sounds like you have had a tough ride with your car mate, hope you get things sorted with it and you get a deal that you want whichever way it goes

don't forget the trading standard and sales of goods acts which are designed to protect consumers, although i am not sure which one would apply more as i think sales of goods normally its within 30 days or purchase or similar although i could be wrong

citizen's advice might be worth contacting if not done so already to see if they can offer any advice

either m8
but i want a replacement on my terms not theirs.
so tbh a refund will be better (more bargaining power at the dealers) but not at todays rates and i think that will be the sticking point , ie bought the car at £17k so i dont want to be offered less , but i think they will say that , so we will have to see.

You won't be offered 17k... after all that's what it was worth 6 months & 7,000 miles ago

You will be offered a mileage altered valuation, based on today's market rate for the car... otherwise you've effectively run a car for free, and the dealer cannot sell the cupra (repaired) for £17k

It just cannot work like that.

Thats not what i have been led to believe m8.
the fault was there from day 1 , the dealers knew it and were in no real hurry to fix the problem hence the 6 months that i have let them fix the car for.
the car has only effectivly ran on 3 cylinders for 6 months , which they have admitted ,
so its not like i had actually been enjoying my car that much and also driven it like it was sold as.

i will keep you all updated with my outcome , although im sure it will be a long drawn out process.

I've just been offered £17,500 for a very well specced S3 (07 plate, 20k miles, FSH), so if you can get that money your doing well mate. Not my words, but the Audi dealer said at least it's grey, because if you'd chosen White / Yellow / Orange you'd have lost another £2k on an S3 immediately as they are so 'niche'. Be warned.

just a note on colours, when i sold my candy white fr the dealer said he would have offered me £1500 less if it had been any other colour than white, bit of a bonus for a standard colour.

My brother has rejected both a Range Rover and a Mercedes (it helped speed things along with the merc because the service manager had moved from range rover and knew he mean't business!). Both were new cars and replaced with new cars.

I know somebody else who had an Audi S4, approved used audi, they couldn't fix something to his satisfication and he got his full money back (he had it for at least 6 months by the time he gave it back).

thanks for the replies guys , will post here when i hear any news.

Autoexpress magazine have a section every month on Readers Woes and im sure they would be interested in hearing about the issue. It may not necessarily be the most 'above the belt' way of dealing with a dealer, but the support of a national car magazine cant do any harm, and seeing as the Dealers name will be printed, their sales may well fall, which in the current climate isnt exactly a favourable situation to be in!

Had a good chat with the managing director from where i bought the car and he was very positive about what has happened but also sympathetic , and has told me that they will assist in any way they can.

My car has also been transfered to another garage for "a fresh pair of eyes" to look at it and they have today ordered some new parts which will be fitted tomorrow in a last ditch attempt to repair it.

so the threat of rejection seems to have got them moving , bout bloody time !

so it may not come to it after all , but it is still the approach i am taking.

will let you know more as soon as i do.

I feel for you i really do, i had a similar situation with a yammy bike, within the first 6 months it had 14 warranty repairs, steep yes, but eventually the dealer sorted it,

Under "Sales of goods act" and "Fitness for purpose" as long as the dealer does everyhing possible to sort the car and Eventually fix it then you'll struggle to get a replacement car unless its a good will gesture,

Its a pain i know because you dont expect it from a 17k car, its the main reason people pay ou for new cars, to hopefully not have reliability probs!

On the other hand if they cant sort it then they dont have a leg to stand on,

good luck with it anyway,

thanks for all the support guys
will let you all know what happens.

cheers ACS intresting reading , similar to my case , glad that skoda are playing ball just wish SEAT did :(

rob i had a simular with my 07 cupra(from new) again the service from seat uk is really p.......ss poor there attitude does need a good foot up there asse ,like you i rejected the car with seats attitude being, take your complaint to the dealer they are accountable for there own business, and that for me was the final straw,,,,,,,,,,,,,,,,,gggrrrrr ,loved the car but wasnt willing to be treat like that when we spent so much money.
but now have a mazda 3 mps ,and have had no issues what so ever, restored my faith in sales people dealing with genuine human beings......lol !!!!!!!!!!!!!!

They could be dragging it out because it's near the 6 month mark.
After 6 months it's your responsibility to prove that it's faulty, before 6 months it's their responsibility to prove it's not.

I was on the border line for the 6 months m8 thats why i had to get the ball moving , even if they manage to fix it , at least to get the process started , and thats going to take weeks to get resolved any way.

What kind of courtesy car did they give you out of interest, and how long have you had it?

The problem i have with SEAT is this , they are the importer ,manufacturer ,owner , its their product , but when it all goes tits up you have to go to your dealer you bought the car from , well in my case its 250 miles away , so any work i need to do is a 500 mile round trip , twice unless its fixed the same day.

Now call me naive but i thought thats what a warranty was for ?
go any where in the SEAT chain and fix your vehicle with SEATs technical help when needed

But SEAT have a customer care department not the dealer you bought it from.

Now this is where the big problem is , if i reject the car cause its faulty i have to do it through the dealership , not the actual company who supplied a faulty vehicle in the first place (SEAT) , but in order to do it SEAT customer care will tell you that you have to give a dealership ( doesnt have to be the 1 you bought it from) ample oppertunity to repair the car.

So you comply and then SEAT turn round and say " helped you all we can its now between you and the dealer you bought the car from"

I am sorry but the words Customer and Care do not go togehter , customer and we will shaft you as long as we can would be a better anology.

You may see this as a rant but unless you are in my situation or have had negative dealings with them you dont know what you have let your self in for , if indeed you do need to make a serious claim or have a serious problem.

Good to see Mazda are good guys , i nearley bought a Mazda 3 mps , perhaps i should of !
